Welcome to Cholo. These Terms of Service ("Terms") govern your use of the Cholo mobile app and website (the "Service"), operated by Cholo ("we", "our", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What Cholo is
Cholo is a technology platform that connects riders with independent, government-verified toto (e-rickshaw) drivers in our service areas. Cholo is not a transport provider and does not own or operate any vehicle. The transport service is provided by the independent driver who accepts your ride. Cholo facilitates booking, fare calculation, and payment between you and the driver.
2. Eligibility
- You must be at least 18 years old to use the Service.
- You must provide a valid Indian mobile number for OTP-based login.
- Drivers must be registered with a valid TTEN (toto registration number) and complete our verification before receiving ride requests.
3. Your account
You log in using a one-time password (OTP) sent to your mobile number. You are responsible for keeping your phone and number secure. You are responsible for activity that takes place under your account. Notify us immediately if you believe your account has been used without your permission — we can revoke access to your account on request.
4. Fares and payments
- The fare for each trip is shown to you upfront before you confirm the booking, based on distance and the selected ride mode.
- You can pay by Cash UPI or Cholo Wallet.
- Fares are inclusive of applicable charges. You agree to pay the fare shown for every completed trip.
- We do not store card numbers or bank account details.
5. Cholo Wallet and top-ups
- You can add money to your Cholo Wallet via UPI through our payment partner (Razorpay). Wallet balance can be used to pay for rides and applicable fees.
- Wallet balance is non-transferable and holds no interest. It cannot be withdrawn as cash except where required by law.
- If a top-up is debited from your bank but not credited to your wallet, contact support with the transaction reference and we will reconcile it.
6. Cancellations and fees
Plans change — we keep cancellations fair to both riders and drivers:
- You may cancel free of charge within 3 minutes of a driver accepting your ride.
- After that 3-minute window, a cancellation fee of ₹20 applies, charged to your wallet, to compensate the driver for travelling to you.
- Drivers who repeatedly cancel accepted trips are automatically suspended from the platform.
7. Rider and driver conduct
To keep Cholo safe and reliable, you agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose;
- Harass, threaten, or endanger a driver, rider, or any other person;
- Damage a vehicle or refuse to pay a legitimate fare;
- Misuse, overload, or attempt to disrupt or reverse-engineer the Service.
Drivers must hold the trip fare as shown, follow traffic laws, and carry passengers safely.
8. Safety
Each trip includes a start PIN that you share with your driver to begin the ride, and a safety screen for emergencies. In any emergency, call the police on 112 directly. Cholo is not a substitute for emergency services.
9. Limitation of liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Cholo is not liable for the acts or omissions of independent drivers or riders, for events outside our reasonable control, or for indirect or consequential losses. Nothing in these Terms limits any liability that cannot be limited under applicable Indian law.
10. Suspension and termination
We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required to protect other users. You may stop using the Service at any time and request deletion of your account.
11. Changes to these Terms
We may update these Terms from time to time. We will change the "Last updated" date above and, for material changes, notify active users in the app. Continuing to use the Service after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of West Bengal.

চলো-তে স্বাগতম। এই পরিষেবার শর্তাবলী ("শর্তাবলী") চলো মোবাইল অ্যাপ ও ওয়েবসাইট ("পরিষেবা") ব্যবহারের নিয়ম নির্ধারণ করে, যা চলো ("আমরা") পরিচালনা করে। অ্যাকাউন্ট তৈরি বা পরিষেবা ব্যবহার করলে আপনি এই শর্তাবলীতে সম্মত হচ্ছেন। সম্মত না হলে অনুগ্রহ করে পরিষেবা ব্যবহার করবেন না।
১. চলো কী
চলো একটি প্রযুক্তি প্ল্যাটফর্ম যা যাত্রীদের সরকার-যাচাইকৃত স্বাধীন টোটো (ই-রিকশা) চালকদের সাথে যুক্ত করে। চলো নিজে কোনো পরিবহন পরিষেবা প্রদানকারী নয় এবং কোনো গাড়ির মালিক নয়। পরিবহন পরিষেবা স্বাধীন চালক প্রদান করেন। চলো শুধুমাত্র বুকিং, ভাড়া নির্ধারণ ও পেমেন্ট সহজ করে।
২. যোগ্যতা
- পরিষেবা ব্যবহারের জন্য আপনার বয়স কমপক্ষে ১৮ বছর হতে হবে।
- OTP লগইনের জন্য বৈধ ভারতীয় মোবাইল নম্বর দিতে হবে।
- চালকদের বৈধ TTEN থাকতে হবে এবং রাইড পাওয়ার আগে যাচাই সম্পন্ন করতে হবে।
৩. আপনার অ্যাকাউন্ট
আপনি মোবাইল নম্বরে পাঠানো OTP দিয়ে লগইন করেন। আপনার ফোন ও নম্বর সুরক্ষিত রাখার দায়িত্ব আপনার। অ্যাকাউন্টের অধীনে হওয়া কার্যকলাপের দায়িত্বও আপনার। অননুমোদিত ব্যবহারের সন্দেহ হলে অবিলম্বে আমাদের জানান — অনুরোধে আমরা আপনার অ্যাকাউন্টের অ্যাক্সেস বাতিল করতে পারি।
৪. ভাড়া ও পেমেন্ট
- প্রতিটি ট্রিপের ভাড়া বুকিং নিশ্চিত করার আগেই দেখানো হয়, দূরত্ব ও রাইড মোড অনুযায়ী।
- আপনি নগদ UPI বা চলো ওয়ালেট দিয়ে পেমেন্ট করতে পারেন।
- প্রতিটি সম্পন্ন ট্রিপের জন্য দেখানো ভাড়া পরিশোধে আপনি সম্মত।
- আমরা কার্ড নম্বর বা ব্যাঙ্ক অ্যাকাউন্টের তথ্য সংরক্ষণ করি না।
৫. চলো ওয়ালেট ও টপ-আপ
- পেমেন্ট পার্টনার (Razorpay)-এর মাধ্যমে UPI দিয়ে ওয়ালেটে টাকা যোগ করতে পারেন।
- ওয়ালেট ব্যালেন্স হস্তান্তরযোগ্য নয় এবং এতে কোনো সুদ নেই।
- টপ-আপের টাকা ব্যাঙ্ক থেকে কাটলেও ওয়ালেটে না এলে, লেনদেনের রেফারেন্স সহ সাপোর্টে যোগাযোগ করুন।
৬. বাতিল ও ফি
- চালক রাইড গ্রহণের ৩ মিনিটের মধ্যে বিনামূল্যে বাতিল করতে পারেন।
- ৩ মিনিটের পরে বাতিল করলে ₹২০ ফি ওয়ালেট থেকে কাটা হয়, চালকের ক্ষতিপূরণ হিসেবে।
- বারবার বাতিলকারী চালক স্বয়ংক্রিয়ভাবে সাসপেন্ড হন।
৭. আচরণবিধি
আপনি সম্মত হন যে আপনি:
- বেআইনি, প্রতারণামূলক বা ক্ষতিকর উদ্দেশ্যে পরিষেবা ব্যবহার করবেন না;
- চালক, যাত্রী বা অন্য কাউকে হয়রানি বা বিপদে ফেলবেন না;
- গাড়ির ক্ষতি বা ন্যায্য ভাড়া দিতে অস্বীকার করবেন না।
৮. নিরাপত্তা
প্রতিটি ট্রিপে একটি স্টার্ট PIN থাকে যা আপনি চালককে দিয়ে রাইড শুরু করেন। যেকোনো জরুরি অবস্থায় সরাসরি পুলিশকে ১১২ নম্বরে কল করুন। চলো জরুরি পরিষেবার বিকল্প নয়।
৯. দায়সীমা
পরিষেবা "যেমন আছে" ভিত্তিতে প্রদান করা হয়। প্রযোজ্য আইন অনুযায়ী, স্বাধীন চালক বা যাত্রীর কাজের জন্য এবং আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরের ঘটনার জন্য চলো দায়ী নয়।
১০. পরিবর্তন ও সমাপ্তি
শর্ত লঙ্ঘন বা অপব্যবহার হলে আমরা আপনার অ্যাক্সেস স্থগিত করতে পারি। আপনি যেকোনো সময় পরিষেবা ব্যবহার বন্ধ করতে পারেন।
১১. প্রযোজ্য আইন
এই শর্তাবলী ভারতের আইন দ্বারা পরিচালিত এবং পশ্চিমবঙ্গের আদালতের এখতিয়ারভুক্ত।
